Terms of Service

By accessing or using Trackk ("Trackk", "we", "us", or "our"), available at trackk.dev, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By creating an account or otherwise using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into this agreement.

Trackk is a project-tracking and launch management platform built for independent software developers and founders. The Service enables you to:

• Track the progress of one or more software projects across defined phases and milestones
• Connect third-party developer tools including GitHub, Vercel, Supabase, Stripe, and Cloudflare
• Monitor commit activity, deployment status, PageSpeed scores, and subscription revenue
• Use a prompt library to accelerate common development workflows
• Receive automated email digests and onboarding nudges

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where practicable.

To use the Service, you must create an account by providing a valid email address and a password, or by authenticating via a supported OAuth provider (such as GitHub). You are responsible for keeping your credentials confidential.

You agree to provide accurate and current information during registration and to update it as necessary. You are solely responsible for all activity that occurs under your account. If you suspect unauthorised access, notify us immediately at hello@trackk.dev.

We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in activity harmful to other users or the platform.

Trackk offers a free tier and paid subscription plans. Paid plans are billed on a monthly or annual basis, as selected at checkout. All payments are processed securely through Stripe, Inc. By subscribing, you authorise Trackk LLC to charge your payment method on a recurring basis until you cancel.

Cancellations. You may cancel your subscription at any time through the Billing section of your dashboard. Cancellation takes effect at the end of the current billing period. We do not provide partial refunds for unused portions of a billing cycle unless required by applicable law.

Price changes.We may change subscription prices with at least 30 days' notice. Continued use of the Service after a price change constitutes your acceptance of the new price.

Taxes. All fees are exclusive of applicable taxes, which you are responsible for paying.

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Transmit malicious code, malware, or any disruptive content
• Scrape, crawl, or systematically extract data from the Service without permission
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Interfere with or disrupt the integrity or performance of the Service

We reserve the right to investigate and take appropriate action against any violations, including removing content, suspending access, and cooperating with law enforcement.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand how we collect, use, and share information about you.

You retain ownership of all data you submit to the Service, including project details, notes, and content ("Your Data"). By using the Service, you grant Trackk LLC a limited licence to host, store, and process Your Data solely to provide and improve the Service.

We implement industry-standard security measures to protect Your Data. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

Trackk connects to third-party services — including GitHub, Vercel, Supabase, Stripe, and Cloudflare — to surface information within your dashboard. When you connect a third-party account, you authorise Trackk to access and display data from that service on your behalf.

Your use of each connected service remains subject to that service's own terms and privacy policy.Trackk LLC is not responsible for the availability, accuracy, or conduct of any third-party service. API tokens and credentials you provide are stored encrypted and are used only to fulfil your dashboard requests.

You may disconnect any integration at any time from the Settings section of your dashboard, which will cause Trackk to stop fetching data from that service.

The Service, including all software, design, text, graphics, logos, and content created by Trackk LLC, is owned by Trackk LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

The Trackk name and logo are trademarks of Trackk LLC. Nothing in these Terms grants you a right to use any trademark, service mark, or trade name of Trackk LLC.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION.

Trackk LLC does not warrant that the Service will meet your requirements, that the results obtained from the Service will be accurate or reliable, or that any errors will be corrected. You use the Service at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRACKK LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.

IN NO EVENT SHALL TRACKK LLC'S AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID TO TRACKK LLC IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100).

You may stop using the Service and delete your account at any time. Account deletion can be initiated from the Settings section of your dashboard or by contacting us at hello@trackk.dev. Upon deletion, your data will be permanently removed within 30 days, except where retention is required by law.

Trackk LLC may terminate or suspend your access immediately, without prior notice or liability, if you breach these Terms. All provisions that by their nature should survive termination — including intellectual property rights, disclaimer of warranties, indemnity, and limitations of liability — will survive.

We reserve the right to update or modify these Terms at any time. When we make material changes, we will notify you by email (to the address associated with your account) and/or by displaying a prominent notice on the Service. The "Effective date" at the top of this page will always reflect the date of the most recent version.

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of those changes. If you do not agree to the updated Terms, you must stop using the Service.

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.
